Welcome to Moo & Company. These Terms of Service ("Terms") govern your use of themooandcompany.com (the "Site") and any orders placed with us. By using the Site or placing an order, you agree to these Terms.

About Us

Moo & Company is a fresh-cut floral and handmade card business based in Hixson, Tennessee, offering flower arrangements under Moo's Blooms and greeting cards under Moo & Me Cards, along with select gift items from local maker partners.

Orders

- Orders may be placed through the Site, by phone, by text, or through our chat widget.

- Order confirmation does not guarantee availability. We will contact you promptly if an item you ordered is unavailable.

- Same-day orders are subject to a daily cutoff time; orders placed after the cutoff will be scheduled for the next available delivery or pickup day.

- We do our best to honor requested delivery dates and times, but delivery windows are estimates and not guaranteed.

Product Substitutions

Because fresh flowers are a natural, seasonal product, availability can change without notice. If a specific flower or item is unavailable, we may substitute it with one of equal or greater value while preserving the color scheme and overall style of your arrangement as closely as possible.

Pricing and Payment

- Prices for arrangements, cards, and gift items are listed on the Site and are subject to change without notice.

- Payment may be collected directly through the Site, via an invoice, or through a text payment link.

- Payments are processed securely through Square and/or Stripe. We do not store your full card number.

- Full payment is due at the time of ordering unless other arrangements have been made with us directly.

Cancellations and Refunds

- Because arrangements are prepared fresh to order, cancellations must be made as far in advance of the scheduled delivery or pickup date as possible.

- Once an arrangement has been prepared or delivery is in progress, we are unable to offer a refund.

- If there is a problem with your order — damaged flowers, a delivery issue, or an error on our part — please contact us within 24 hours so we can make it right.

Delivery and Pickup

- You are responsible for providing an accurate delivery address and contact information.

- We are not responsible for delays caused by incorrect address information, recipient unavailability, or circumstances outside our control (weather, traffic, etc.).

- If no one is available to receive a delivery, we will use reasonable judgment to leave the arrangement in a safe location or attempt to contact you for further instructions.

Communications

By providing your email address or phone number, you agree to receive order-related communications from us by email, text, and/or chat. Text messaging is subject to the terms described in our Privacy Policy, including the ability to opt out at any time by replying STOP.

Intellectual Property

All content on the Site — including text, photos, designs, and logos — is owned by Moo & Company or used with permission and may not be copied or reused without our consent.

Limitation of Liability

To the fullest extent permitted by law, Moo & Company is not liable for any indirect, incidental, or consequential damages arising from your use of the Site or an order placed with us. Our total liability for any claim related to an order will not exceed the amount paid for that order.

Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Continued use of the Site after changes are posted means you accept the updated Terms.

Governing Law

These Terms are governed by the laws of the State of Tennessee, without regard to its conflict of law principles.
